Pursuit Broker Services Terms & Conditions

These Terms and Conditions govern the provision of services by QED Credit Services Pty Ltd ACN 139 220 492 trading as Pursuit Broker Services ("Pursuit Broker Services", "PBS", "we", "us", "our") to any individual, sole trader, company, partnership or other entity ("you", "your", "Representative").

By applying to become, or acting as, a Credit Representative of Pursuit Broker Services ("PBS"), you agree to these Terms and Conditions.

Services

PBS provides Credit Representative authorisation, compliance monitoring, file reviews, compliance guidance, lender accreditation support, complaints management assistance and related services.

Your Responsibilities

You agree to:

• Comply with all applicable laws, including the National Consumer Credit Protection Act 2009.
• Follow PBS policies, procedures and compliance requirements.
• Maintain any required professional indemnity insurance and dispute resolution memberships.
• Co-operate with audits, file reviews and compliance monitoring.
• Notify PBS promptly of complaints, claims, investigations, breaches or changes to your business details.

Fees

Fees are payable in accordance with PBS's current pricing schedule.

PBS may amend its fees by providing at least 30 days' notice. Continued use of PBS services after notification constitutes acceptance of the revised fees.

Compliance Monitoring

PBS may conduct audits, reviews and monitoring activities to meet its regulatory obligations. You agree to provide any information reasonably requested by PBS for these purposes.

Confidentiality

Both parties agree to keep confidential any business, customer or operational information obtained during the relationship, except where disclosure is required by law or regulatory obligations.

Intellectual Property

All PBS systems, documents, manuals, compliance tools and related intellectual property remain the property of PBS and must not be copied, reproduced or distributed without written consent.

Independence

Appointment as a Credit Representative does not create an employment, partnership or agency relationship with PBS. You remain responsible for your own business operations and legal obligations.

Indemnity

You agree to indemnify PBS, its officers, employees and insurers against any loss, claim, liability, penalty, cost or expense arising from your conduct, breach of law, negligence or failure to comply with these Terms. This obligation continues after termination.

Termination

Either party may terminate the relationship by providing one month's written notice.

PBS may suspend or terminate authorisation immediately where it reasonably believes its licence obligations, reputation or compliance requirements may be compromised.

Limitation of Liability

PBS provides its services with due care and skill but makes no guarantee regarding business performance, profitability or specific outcomes.

To the extent permitted by law, PBS is not liable for any indirect or consequential loss arising from the use of its services.

Changes to These Terms

PBS may update these Terms and Conditions from time to time by publishing revised terms on its website. Continued use of PBS services constitutes acceptance of any updated terms.

Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.
